The United Kingdom Supreme Court
has today handed down judgment in Jones v Kaney (http://www.bailii.org/uk/cases/UKSC/2011/13.html).
Whilst the question put to the
Court was quite narrow [2]: “whether the act of preparing a joint
witness statement is one in respect of which an expert witness enjoys immunity
from suit.” The majority dealt
with the broader issue, and abolished the immunity from suit for
breach of duty that expert witnesses previously enjoyed in relation to their
participation in legal proceedings.
